Welcome to Makify AI. By accessing, registering for, or using the services available at makifyai.com (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree with any part of these Terms, please do not use the Service.

2. Description of the Service

Makify AI is an independent platform that provides AI image, AI video, and related creative tools. Users can generate images, videos, and other content from their inputs using artificial-intelligence models. Features, models, pricing, and availability may change over time as the Service evolves.

3. Accounts and User Responsibilities

You must provide accurate and complete information when creating an account and keep it up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us promptly of any unauthorized use of your account.
You must have the legal capacity to agree to these Terms under the laws that apply to you.

4. Acceptable Use and Prohibited Conduct

You agree not to use the Service to:

engage in any unlawful or fraudulent activity;
create, host, or distribute phishing content, malware, or spam;

attempt to gain unauthorized access to the Service or related systems, or bypass its security features or usage limits;
resell or redistribute the Service without authorization.

You are responsible for the content you submit, the generations you request, and the lawfulness of how you use the results.

5. User Content and License

You retain the rights you lawfully hold in the content you submit to the Service.
You grant Makify AI a limited license to process your content as reasonably necessary to operate, provide, secure, and improve the Service.
You confirm that you have the necessary rights to the content you submit, and that you will not upload content that infringes third-party rights or that you are not authorized to use.

6. AI Outputs

AI-generated outputs may be inaccurate, incomplete, or similar to outputs generated for other users.
Whether and how you may use an output depends on applicable law, your inputs, the rights of third parties, and the terms of the third-party models involved.
We do not guarantee that any output is eligible for copyright protection or can be used commercially in every situation. Please review outputs carefully before relying on them.

7. Platform and Third-Party Intellectual Property

The Makify AI platform — including its code, interface, brand, and original content — is protected by intellectual-property laws and remains the property of makifyai.com.
The third-party AI models, trademarks, and technologies referenced or used by the Service remain the property of their respective owners. Makify AI does not claim ownership of any third-party model.

8. Independent Platform Disclaimer

Makify AI (makifyai.com) is an independent platform. It is not owned, operated, sponsored, or endorsed by OpenAI, Google, xAI, ByteDance, Black Forest Labs, Alibaba, MiniMax, Ideogram, Kuaishou, Luma AI, PixVerse, Recraft, Midjourney, Stability AI, or any other AI model provider.

References to third-party models, technologies, or brand names on this platform are used for descriptive purposes only, to indicate compatibility or the underlying technology behind certain features.
Model and product names referenced on the platform — such as GPT Image, Nano Banana (Gemini), Veo, Imagen, Grok, Seedream, Seedance, Flux, Qwen, Wan, Z-Image, Hailuo, Kling, and Ideogram — are trademarks or products of their respective owners.
All trademarks, service marks, logos, and model names mentioned on the platform belong to their respective owners.
Makify AI maintains its own policies and user agreements, which are independent from those of any third party.

9. Payments, Credits, and Subscriptions

Prices, credit amounts, plans, and subscription terms are as displayed at the time of purchase.
Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. Cancellation takes effect at the end of the current billing period.
You agree to pay the charges associated with the plan or purchase you select.
Refunds are governed by our Refund Policy.

10. Suspension and Termination

We may limit, suspend, or terminate access to the Service where we reasonably believe an account violates these Terms, creates a security risk, is involved in abuse or fraud, or where we are required to do so by law. Where appropriate, we will review reported issues and consider good-faith appeals, including cases involving mistaken reports or issues that have since been resolved.
